Terms of Service

qikfox Cybersecurity Systems, Inc.

1. Agreement

These Terms of Service (the “Terms”) form an agreement between you and qikfox Cybersecurity Systems, Inc. (“qikfox”, “we”, “us” or “our”). By downloading, installing or using a qikfox product, by creating an account, or by using this website, you agree to these Terms. If you do not agree, do not use the products.

If you accept these Terms on behalf of a company or other organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

You must be at least 18 years old, or the age of majority where you live, to buy a paid plan. Nothing in these Terms limits consumer rights that cannot lawfully be excluded or restricted.

2. The products

These Terms cover qikfox Search, qikfox Safe Browser, qikfox Antivirus and qikfox VPN, together with the member portal, the app store listings and any related add-ons and AI features. Some products or features are available only on certain platforms or in certain regions; availability is described on each product page. Our current operating region is North America.

AI-assisted features produce generated output. Output can be incomplete or wrong, and it is not professional, legal, financial or security advice. Check anything important before you rely on it.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the products for their intended purpose, for the number of devices and users your plan allows. You may not resell, rent, sublicense or host the products for third parties, reverse engineer them except where law expressly permits it, remove proprietary notices, or use them to build a competing product.

You keep ownership of the content you create or submit. You grant us only the permissions needed to operate the products for you, such as storing your settings, delivering your content between your own devices, and processing a request you make of an AI feature.

4. Acceptable use

You agree not to use qikfox products to:

• break the law or infringe the rights of others;
• attack, overload, probe or interfere with any network or service, including ours;
• distribute malware, conduct fraud or phishing, or send unsolicited bulk messages;
• circumvent usage limits, security controls or region restrictions;
• share credentials beyond what your plan permits, or resell access to your subscription;
• scrape, mine or bulk-extract our services, or automate them beyond documented interfaces.

The Acceptable Use Policy gives further detail and forms part of these Terms. We may suspend or limit access where use of a product causes harm, risks the stability or security of the service, or breaches these Terms. Where practical and lawful, we will tell you first and give you an opportunity to put things right.

5. Accounts

You are responsible for the accuracy of your account details, for keeping your credentials secure, and for activity carried out through your account. Notify us promptly if you believe your account has been compromised. Accounts are for the named holder; team plans may add members through the portal, and the account owner remains responsible for their use.

We may decline or close an account where verification fails, where a payment cannot be validated, or where an account is used to breach these Terms.

6. Subscriptions, billing and cancellation

Paid plans renew automatically for the term you selected unless cancelled before the renewal date. Prices, billing periods, taxes and trial terms are shown at purchase, and renewal reminders are sent where required by law. You authorise us and our payment providers to charge your saved payment method for each renewal until you cancel.

You can cancel online in your subscriptions in the member portal in a few steps, with no phone call and no retention step. We may change prices for future terms, and will give notice before a change takes effect so you can cancel first. Refund periods, online cancellation and the rights that apply on top of them are set out in the Refund and Cancellation Policy, which forms part of these Terms.

If a payment fails, we may retry it and may suspend paid features until the balance is settled. Where a purchase was billed by an authorised reseller or marketplace, that provider’s billing terms also apply to the transaction.

7. No guarantee of complete protection

Security software reduces risk; it does not eliminate it. New threats appear continuously and no product detects all of them. qikfox does not warrant that a product will identify every deceptive page, malicious file or network attack, and a VPN does not make you anonymous to services you sign in to. You remain responsible for keeping your devices updated and for maintaining your own backups.

8. Third-party content and services

The products let you reach content, sites, apps and services we do not control. We are not responsible for that content, and links, search results or store listings are not endorsements. Your use of a third-party service is governed by that provider’s own terms.

9. Changes to the products

We may add, change or discontinue features, and we may perform maintenance that briefly interrupts a service. Where a change materially reduces functionality on a paid plan, we will tell you and describe the options available, which may include cancelling for a refund of the unused portion where the Refund and Cancellation Policy or applicable law provides for one.

10. Intellectual property

qikfox, the qikfox logo and our other names and marks belong to us; these Terms grant you no right to use them except as needed to use the products normally. All rights in the products not expressly granted are reserved. Open-source components remain under their own licences, which we make available with the software, and those licences prevail over these Terms for the components they cover.

If you send us feedback or suggestions, we may use them to improve our products without obligation to you.

11. Disclaimers

To the fullest extent permitted by law, the products and this website are provided “as is” and “as available”, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the products will be uninterrupted, error-free or capable of detecting or blocking every threat.

Some jurisdictions do not allow the exclusion of certain warranties. Where that applies to you, the exclusions above apply only to the extent permitted, and you keep every warranty and remedy that cannot lawfully be excluded, including under the laws of your state, province or territory.

12. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or the cost of substitute services, arising out of or relating to these Terms or the products, even if advised of the possibility.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the products is limited to the greater of (a) the amounts you paid us for the affected product in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars.

These limits do not apply to liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence or wilful misconduct, a party’s payment obligations, or any other liability that cannot lawfully be limited. If you are a consumer, nothing in this section reduces your rights under mandatory consumer protection law, including your right to remedies for a product that is defective, misdescribed or not delivered.

13. Indemnity

If you use the products for business purposes, you agree to defend and indemnify qikfox against third-party claims, damages and reasonable costs arising from your breach of these Terms, your infringement of a third party’s rights, or your unlawful use of the products. This section does not apply to consumers to the extent applicable law prohibits it.

14. Termination

You may stop using the products at any time and cancel a paid plan in the member portal. We may suspend or terminate access for a material breach of these Terms, for unlawful use, for non-payment, or where required by law. On termination your licence ends and you must stop using the products; provisions that by their nature should survive, including sections 10 to 13 and 16, continue to apply.

If we terminate a paid plan without cause, we will refund the unused portion of the term you have already paid for.

15. Privacy

How we handle personal information is described in the Privacy Policy. Your choices about tracking and sale or sharing of personal information are available on the privacy choices page.

16. Governing law and disputes

Mandatory consumer-law exception. The governing-law and jurisdiction provisions below do not apply to consumers resident in Quebec, nor to any other consumer to the extent prohibited by applicable mandatory law. Nothing in this section removes your right to rely on the mandatory consumer protections of your home state, province or territory, or to bring a claim in a court whose jurisdiction cannot lawfully be excluded.

16.1. Subject to that exception, these Terms are governed by the laws of the State of California and the applicable federal laws of the United States, without regard to conflict-of-laws rules.

16.2. Subject to the same exception, disputes arising out of or relating to these Terms are subject to the exclusive jurisdiction of the state courts located in San Mateo County, California, or, where federal jurisdiction exists, the United States District Court for the Northern District of California.

16.3. Please contact us first through the contact page so we can try to resolve a dispute informally. Doing so is not a condition of exercising your legal rights, and either party may seek injunctive relief for misuse of intellectual property or unauthorised access at any time.

16.4. Nothing in these Terms restricts your right to contact a consumer protection authority or to exercise any other non-waivable remedy.

17. Changes to these Terms

We may update these Terms. We will publish an updated effective date and describe material changes, and give advance notice where required by law. Changes do not apply retroactively to a dispute already raised. Continued use after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the products and cancel any paid plan.

18. General

These Terms, together with the Acceptable Use Policy, the Refund and Cancellation Policy and the Privacy Policy, are the entire agreement between us about the products. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. The products are subject to applicable export control and sanctions laws.
